Plaintiff was a middle-aged man who was born severely brain damaged. Plaintiff’s mother never knew the cause of the brain damage until many years later she discovered that defendant company had dumped chemicals next to her house: chemicals containing lead, which is known to cause severe brain damage.
Winer, Burritt & Scott, LLP, litigated this case along with associated trial counsel. After verdict, the case settled for the full amount of the verdict.
Plaintiffs were able to establish through expert testimony that the dumped chemicals should have been cleaned up far in advance of plaintiff’s injury and that it was the chemicals, as opposed to other potential factors, which caused plaintiff’s brain injury.
