Plaintiff was a middle-aged man who presented to the emergency room of a hospital with symptoms which were consistent with a heart attack. The emergency room doctors concluded that the plaintiff did not suffer from a heart attack, but was only suffering from anxiety and sent him home. In fact, plaintiff did have a heart attack and the lack of treatment aggravated his symptoms and caused a permanent heart injury.
The case settled for the maximum amount of general damages allowed under California medical malpractice law.
RESULT: $250,000 settlement on behalf of plaintiff
