$300,000 – Nurse has Non-Surgical Back Injury as Result of Automobile Accidents

This case involved an emergency room nurse in her late thirties who was in one high-speed and one very low-speed accident within five months of each other. She claimed a disc herniation as a result of the two accidents. The case was originally handled by another lawyer who settled with the other drivers, and, the case was referred to the law offices of Winer, Burritt & Scott, LLP, to file and litigate an under-insured motorist claim.

In the under-insured motorist claim, the defense alleged that plaintiff was fully compensated by the prior settlements and that the herniated disc which showed up on an MRI and CAT scan was unrelated to these accidents.

The law offices of Winer, Burritt & Scott, LLP, established that 4 IDET procedures performed on plaintiff were in fact like surgeries and plaintiff was highly credible and that her symptoms were consistent with a herniated disc and that plaintiff suffered a considerable income diminution as a result of not being able to work as an emergency room nurse after the accident.

RESULT: $300,000 settlement on behalf of plaintiff
