$750,000 – Bad Faith Termination of Disability Insurance Benefits to Former Paralegal with Traumatic Brain Injury

Plaintiff was a paralegal for nearly twenty years until he was hit by a car and rendered unconscious. The result of this accident was traumatic brain injury that severely impaired his ability to reason, to think clearly and quickly, and to make decisions. This brain damage and resulting cognitive impairments were objectively verified by several board certified neurosurgeons and documented in MRIs and CT scans.

Plaintiff filed for disability benefits under his insurance policy that guaranteed him a lifetime of monthly benefits should he ever become totally disabled from performing the substantial and material duties of a paralegal. His benefits were terminated in bad faith, despite the fact that Plaintiff had a team of board certified neuropsychologists who felt Plaintiff was permanently cognitively disabled. Winer, Burritt & Scott, LLP, associate Jennifer Prusak, while with another law firm, was heavily involved in every aspect of this case, from written discovery to the defending of key depositions to mediation. The end result of Ms. Prusak’s and her former law firm’s involvement in this case was a successful settlement for Plaintiff.

RESULT:
$750,000 settlement on behalf of Plaintiff
