Case Spotlights

Skateboarder Suffers Crush Injury In Muni Bus Accident

A 15-year-old boy boarding down the center of Clement Street in San Francisco was passing a Muni bus that he knew always went straight at the subject intersection. However, this time the bus turned in front of the plaintiff, and he was crushed by the tires of the bus and suffered a crush injury and severed urethra.

The city of San Francisco claimed no injury and forced the case to trial. The plaintiff claimed the bus didn’t signal, which the city disputed. The attorneys for the city took bets on how long the jury would be out before it returned a defense verdict in favor of the city. The longest estimate was 30 minutes. After two full days of deliberation, the jury hung and the stunned city settled the case for a confidential amount.

Result: Confidential settlement.

Man In Wheelchair Falls From Muni Bus Chair Lift

A wheelchair-bound plaintiff in his 30s suffering from brittle bone disease exited a Muni bus on a wheelchair lift. He alleged the wheelchair lift was improperly manufactured and the operator improperly lowered the lift by raising the end ramp of the lift too early, which caused the plaintiff to run into the end ramp and topple over. He landed flat on his back, which significantly worsened his pre-existing condition and required extensive past and future treatment. Both defendants denied fault, and after a hard-fought litigation with many expert witnesses, the case settled for a confidential amount.

Result: Confidential settlement.
