Plaintiff in this case was a middle-aged female clerical worker who was involved in an automobile accident with a drunk driver. As a result of the accident, she suffered a minor whiplash injury and depression.
A prior law firm handled the case and was unable to obtain a significant offer, so the case was referred to law offices of Winer, Burritt & Scott, LLP.
Recognizing that the case had value because a jury would become angry at a drunk driver, the law firm retained a toxicologist to testify to the significance of the defendant’s blood alcohol level and a psychologist to evaluate the plaintiff and demonstrate that her psychological distress was significant, despite the fact that her whiplash injury was insignificant.
The case settled for the drunk driver’s policy limits.
