Plaintiff in this case was a 35-year-old woman who was seeing an anesthesiologist who was a chronic pain specialist. Plaintiff had chronic pain after multiple failed back surgeries. The anesthesiologist had the plaintiff on a number of different drug “cocktails” which significantly affected her inhibitions. Plaintiff alleged that the physician inappropriately entered into a sexual relationship with her. The physician denied the sexual relationship and stated that all medical treatment was reasonable. The law offices of Winer, Burritt and Scott, LLP, was able to find proof which tended to indicate that the sexual relationship existed and that, due to the defendant’s position of power as her doctor and over-medication, plaintiff could not consent to the relationship.
RESULT: Settlement on behalf of plaintiff of $250,000
